About these terms
These Terms and Conditions (“Terms”) govern your use of the website at https://centurypoolsnorthcoast.com.au/ (the “website”), operated by Century Pools Pty Ltd (ABN 18 656 162 622), trading as Century Pools North Coast (“we”, “us” or “our”).
Century Pools North Coast supplies and installs fibreglass swimming pools across the NSW North Coast, from Tweed Heads to Coffs Harbour. NSW Builder’s Licence No. 101096C.
Acceptance of these terms
By accessing or using the website, you agree to be bound by these Terms. If you do not agree, please do not use the website.
These Terms apply to your use of the website only. Any supply and installation of a pool is governed by a separate written quote and contract between you and us.
Use of the website
You may use the website for lawful purposes, such as finding information about our pools and services and contacting us. You must not:
- use the website in a way that breaks any law or infringes anyone’s rights
- submit false, misleading or offensive information through our forms
- attempt to gain unauthorised access to the website, its servers or any connected systems
- introduce viruses, malicious code or anything else that may harm the website or other users

- interfere with the proper working of the website
We may suspend or restrict access to the website, or any part of it, at any time without notice, including for maintenance.
Pricing, estimates and no offer
Indicative pricing only
Any prices, price ranges, estimates, package examples or results from calculators or similar tools on the website are indicative only. They are provided as a general guide and are not a quote, an offer or a binding price.
The actual cost of your pool depends on many factors, including site access, soil and ground conditions, excavation, rock, drainage, council and certification requirements, fencing, electrical and plumbing work, landscaping, the pool model and options selected, and the cost of materials and labour at the time.
Formal written quote
A formal written quote will only be provided after a site inspection. No contract is formed by your use of the website, submitting an enquiry or quote request, or receiving an indicative price. Any agreement to supply and install a pool will be set out in a separate written contract, which will prevail over anything on the website.
Promotions
Any promotions or special offers shown on the website are subject to their stated terms, availability and conditions, and may be changed or withdrawn at any time.
Accuracy of information and images
We take reasonable care to keep the information on the website accurate and up to date. However, information may change, and we do not guarantee that all content is complete, current or free from errors.
Pool colours, sizes and images
Photos, videos, renders and illustrations on the website are for illustration purposes only. In particular:
- pool colours and finishes may look different on screen than in real life, and can vary with lighting, water conditions, depth and the surrounding environment
- pool dimensions, depths and volumes shown are nominal and may vary slightly due to manufacturing tolerances
- images may show optional extras, landscaping, fencing, decking or features that are not included in a standard price
- pool models, shapes, colours and specifications may change or be discontinued by the manufacturer
We recommend viewing physical colour samples and confirming all specifications with us before you sign a contract.
General information only
Information on the website (including about pool ownership, maintenance, council approvals, safety barriers and regulations) is general in nature and does not take into account your particular circumstances. You should seek specific advice before making decisions.
Intellectual property
All content on the website, including text, images, videos, logos, graphics, designs and layout, is owned by or licensed to us and is protected by Australian and international intellectual property laws. The Century Pools name and logos may be trade marks of their respective owners and are used under licence where applicable.
You may view, download and print content from the website for your own personal, non-commercial use. You must not otherwise copy, reproduce, modify, distribute, publish or use any content without our prior written permission.

Limitation of liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted or modified (“Non-Excludable Rights”).
Our liability
Subject to your Non-Excludable Rights and to the extent permitted by law:

By using the website, you acknowledge that you have read our Privacy Policy.
Governing law
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that may hear appeals from them.

General
